Frequently asked questions about the new WHS laws Safe Work Australia is an Australian Government statutory agency, which was established to drive the development and implementation of model WHS legislation.

This toolkit provides information and guidance to WHS InspectorPractitioners/Advisors, HSRs and workers on the roles and function of a Comcare WHS Inspector under the WHS Act. There is information for Inspector/Investigator about:

Inspectors under the Work Health and Safety laws will have a focus on prevention and co-operation to improve the health, wellbeing and safety experience for workers. Comcare’s compliance and enforcement strategies range from encouraging better practice through partnerships with employers with mature safety systems, through to audit and assurance activities for PCBUs who are still developing their compliance systems and capability. Each year, Comcare identifies a series of specific health and safety related priorities aimed at continuing to improve worker health and safety. The priorities form the basis of Comcare’s targeted health and safety interventions and activities.

Comcare aims to target efforts to those that do not get the safety message and to areas that present as highest risk—in either workplace health or safety. This approach ensures that there is efficiency in service delivery and productivity loss is minimised.

Comcare applies a range of information, education, advice and assistance under the previous Occupational Health and Safety Act 1991 (the OHS Act) and will continue to align with the Work Health Safety Act 2011 (Cth) (WHS Act). This range of options seeks to encourage better practice through partnerships and collaboration with employers and employees under the OHS Act and with PCBUs and workers under the WHS Act.

If a duty holder is found to be not complying with duties and obligations, a range of enforcement options is available under both the current and new health and safety legislation.  A combination of better practice, compliance and enforcement measures may be applied that are appropriate to the circumstances.
