Collection of personal information

Comcare may collect personal information directly from an individual in a range of circumstances, including:

Under the Privacy Act 1988 (Privacy Act), Comcare can only collect personal information for lawful purposes required to, or related to, carrying out Comcare’s functions under the legislation administered by Comcare - including the SRC Act, OHS Act and associated Regulations.

Any personal information collected by Comcare from a third party (such as a claimant’s employer, health professional or other health institution, case manager, rehabilitation provider, a Comcare Investigator etc) about an individual must be relevant to carrying out Comcare’s functions and can not unreasonably intrude on the affairs of the individual.

Collection of your information when visiting Comcare’s Website

When you visit our website, we record anonymous information about your visit. The information recorded only tells us how you use the site. It does not record any personal information about you.

We will collect personal information about you if you email us through the Comcare website or submit an online form.

Comcare’s website abides by the Guidelines for Federal and ACT Government Websites issued by the Australian Privacy Commissioner.

Use of your personal information

Comcare can only use your personal information for the purpose it was collected.

Prior to using your personal information, Comcare must ensure that the information is relevant, accurate, up-to-date and complete.

Under IPP 10, Comcare may use your personal information for a purpose other than the prupose it was collected for:

  • you have consented to Comcare using your personal information for that other purpose
  • the use of the information is necessary to prevent or lessen a serious and imminent threat to life or health
  • the use of the information for that other purpose is required or authorised by or under law
  • the use of the information for that other purpose is reasonably necessary for enforcement of the criminal law or of a law imposing a pecuniary penalty, or for the protection of the public revenue
  • the purpose for which the information is used is directly related to the purpose for which the information was obtained

Disclosure of personal information

Comcare can not disclose your personal information to another person, body or agency unless:

  • you provide consent for the disclosure
  • you have been made aware, or are within reason likely to be aware that Comcare usually passes your information to that person, body or agency
  • the disclosure is necessary to prevent or lessen a serious threat to life or health
  • the disclosure is required or authorised by law
  • the disclosure is necessary for the enforcement of a criminal law, law imposing a financial penalty or the protection of public revenue
