Reconsiderations & reviews

If you do not agree with a decision made by Comcare then you can:



Request a reconsideration

If you think a decision made by Comcare on your claim is wrong, you can request a reconsideration by someone who was not involved in the original decision.

You will need to put your request in writing and include the following details:

  • date of the original decision
  • why you don't agree with that decision
  • any new information (e.g. medical reports or x-rays)

Please make your request within 30 days of receiving the original decision (or ask for an extension if you need more time). Send your request for a reconsideration to: Comcare, GPO Box 9905, Canberra, ACT, 2601.

If you decide to use a solicitor to help you, any legal costs will be your responsibility regardless of the outcome.

What happens after I request a reconsideration?

The reconsideration officer will:

  • review the original decision
  • assess any new evidence provided by you
  • issue a written decision

Will my employer be involved?

Your employer will receive a copy of your request and may provide comments regarding your request.

They also have the same rights to request a reconsideration of a decision. We will notify you if your employer requests a reconsideration of a decision made on your claim.

Request a review by the Administrative Appeals Tribunal

If you do not agree with the reconsideration decision, you can seek a review of that decision by the Administrative Appeals Tribunal (AAT).

There are specific rules you must follow when applying to the AAT. These will be explained to you when you are issued the reconsideration decision.
