Statutory rates

  • Section 13 of the SRC Act provides for indexation of defined compensation benefits by reference to the Consumer Price Index.
  • Section 13AA provides for annual indexation of death compensation entitlements by reference to the Wage Price Index.
  • Determining authorities under the Comcare scheme are unable to pay more than the statutory amount.
  • The statutory amounts payable from 1 July 2016 are provided in Table 1.

Table 2: SRC Act Section 16(6) Specified Rate per Kilometre

  • Determining authorities may pay compensation where an employee reasonably incurs expenditure for travel for medical treatment by private motor vehicle.
  • The total distance travelled must exceed 50 kilometres as prescribed in subsection 16(7).
  • The SRC Act provides that the Minister specifies, by Legislative Instrument, the specified rate per kilometre.
  • The specified rate per kilometre, as specified by the Minister from time to time, is provided in Table 2.

Table 3: SRC Act Subsection 19(5) Maximum amount of compensation after 45 weeks' incapacity (being 150% of AWOTEFA)

  • Subsection 19(5) of the SRC Act sets an upper limit on weekly incapacity compensation payments after the first 45 weeks of incapacity.
  • This limit is set at 150 per cent of the Average Weekly Ordinary Time Earnings of Full-time Adults (AWOTEFA). The AWOTEFA is published by the Australian Statistician.
  • The biannual AWOTEFA amounts are provided in Table 3.

Table 4: SRC Act Subsection 20(3) Changes to Superannuation Amount for Superannuation Funds Managed by the Commonwealth Superannuation Corporation

  • The Government portion of superannuation pensions paid under the Commonwealth superannuation schemes are indexed by the Consumer Price Index (CPI).
  • The Commonwealth Superannuation Corporation reviews the employer funded portion of the Commonwealth superannuation scheme pensions twice a year in line with movements in the CPI. The CPI adjustment is then applied to superannuation pensions in January and July.
  • The biannual indexation percentage is provided in Table 4.

Table 5: SRC Act Subsection 21(5) Specified Rate of Weekly Interest on Lump-sum Superannuation Amounts

  • A specified rate on superannuation lump sums applies to the calculation of weekly incapacity compensation under section 21 or 21A of the SRC Act.
  • The SRC Act enables the Minister to specify, by Legislative Instrument, a rate that applies for a period of 12 months commencing on 1 July in any year.
  • The annual interest rate specified by the Minister is provided in Table 5.

Table 6: SRC Act subsection 8(9B) and subsection 8(9F) increase rates for normal weekly earnings adjustment

  • Subsection 8(9B) of the SRC Act provides for an annual increase to normal weekly earnings (NWE) by reference to the Wage Price Index (WPI).
  • Subsection 8(9F) of the SRC Act provides for an increase to NWE for employees who are employed (current employees) by the Commonwealth or a licensee, where there has been no increase to their NWE in the 12 months ending 30 June each year.
  • The movement in the WPI published by the Australian Statistician is used to ascertain the percentage increase to be applied to the NWE in the above two subsections.
  • The annual indexation percentage is provided in Table 6.
