Safety, Rehabilitation and Compensation Act 1988
The legislative basis for the Commonwealth Government's compensation scheme is the Safety, Rehabilitation and Compensation Act 1988 (the SRC Act). The SRC Act establishes a fully funded premium based system and a licensed self-insurance based system of compensation and rehabilitation for employees who are injured in the course of their employment. It covers all Commonwealth employees, including members of the Australian Defence Force (ADF), and employees of certain private sector corporations. ACT Public Service employees are also covered by virtue of the ACT Public Service having been declared a Commonwealth authority for the purposes of the SRC Act on 30 June 1994. Comcare and the Safety, Rehabilitation and Compensation Commission are established under the SRC Act, which outlines the role and functions of both bodies including administrative, regulatory and service responsibilities. The SRC Act includes a comprehensive benefit structure that includes the payment of the reasonable cost of medical treatment, income replacement for periods of incapacity for work and payment of lump sums for permanent impairments
