Relationship between the FCIT and Other Staff/Agencies
The Employing Agency
COMCARE contact with an employing agency is generally with the agency Case Manager, or less frequently with the agency manager who may have requested the investigation. In the initial stages of an investigation the relationship often commences with the agency supplying information to Comcare.
Following an investigation, the FCIT may provide an Investigation Report containing relevant recommendations to the agency. This may include a recommendation to charge the claimant under the Public Service Act 1922. All such communications are examined to ensure they comply with the Privacy Act 1988.
Other services available to Employing Agencies include:
- Advice on worker’s compensation fraud prevention
- Presentations to staff engaged in worker’s compensation management
- Detailed advice on specific cases of suspected fraud or serious non-compliance
- Presentations to senior staff on worker’s compensation fraud issues
AAT Managers / Officers
Matters concurrently in the AAT & criminal jurisdiction require careful coordination. In these circumstances joint decisions on strategy are taken and frequent information exchanged. The exchange of evidence may be possible but considerable caution is used to ensure that the Privacy Act or other legislation is not breached.
