When an Investigator Calls

Purpose of this guide

The purpose of this guide is to provide information on the role, powers and activities of investigators appointed under the Occupational Health and Safety Act 1991 (the Act). Information is also provided about the enforcement provisions of the Act.

Who should read this document?

In the context of the Act, anyone who holds a duty relating to occupational health and safety (OHS) should read this guide. Duties holders under the Act are:

  • Commonwealth departments, agencies, authorities, and Government Business Enterprises (GBEs);
  • Employees of Commonwealth departments, agencies, authorities, and GBEs;
  • Non-Commonwealth licensees and their employees;
  • Manufacturers and suppliers of plant and substances; and
  • Persons erecting or installing plant in the workplace
In particular, employers should read this guide to inform themselves as to what they might expect when a Comcare investigator visits a workplace when conducting an OHS investigation.
