Enforcement policy
The purpose of this Enforcement Policy is to explain the investigative and enforcement provisions of the Occupational Health and Safety Act 1991 (OHS Act) and the principles that govern how these will be applied.
Who should read this policy?
In the context of the OHS Act, anyone who holds a duty relating to occupational health and safety (OHS) should read this policy.
Duty holders under the OHS Act are:
- Commonwealth departments, agencies, authorities, and Government Business Enterprises (GBEs)
- Employees of Commonwealth departments, agencies, authorities, and GBEs
- Non-Commonwealth licensees
- Employees of non-Commonwealth licensees
- Manufacturers and suppliers of plant and substances, and
- Persons erecting or installing plant in the workplace.
