Comcare granted leave to appeal PVYW decision

The High Court today granted Comcare’s special leave to appeal application in the PVYW case.

In that case, a Commonwealth employee was awarded workers' compensation for injuries sustained after a light fitting was pulled from the wall of a motel during sex, on a business trip.

Comcare is seeking a ruling from the High Court that the circumstances surrounding an injury may be relevant to an assessment of whether an injury occurs ‘in the course of employment’.

Comcare’s original appeal to the Full Federal Court in the case was dismissed in December last year.

The date for the hearing is expected to be in August this year.
