Available information

Practical guidance material is currently being developed about a range of issues which arise in the context of investigations and enforcement activities. These issues include:

  • the privilege against self-incrimination;
  • the content of employers' duty to take 'all reasonably practicable steps' to protect the health and safety of employees;
  • the considerations informing decisions to take enforcement action;
  • the protection provided to employees by s 76 of the Occupational Health and Safety Act 1991; and
  • the investigation of workplace fatalities
