Comcare Enforcement Policy
Purpose of this Policy
The purpose of this policy is to explain the investigative and enforcement provisions of the Occupational Health and Safety Act 1991 (the Act) and the principles that govern how these will be applied.
This policy lays the foundation for Comcare to establish a benchmark for other regulators to follow. It will be supplemented by materials that provide an unprecedented level of guidance on the principles and processes that underpin compliance and enforcement action. This suite of material supports and reflects Comcare’s efforts to achieve accountability, transparency, consistency, and proportionality in all of its regulatory activities.
Who should read this policy?
In the context of the Act, anyone who holds a duty relating to occupational health and safety (OHS) should read this policy. Duties holders under the Act are:
- Commonwealth departments, agencies, authorities, and Government Business Enterprises (GBEs);
- Employees of Commonwealth departments, agencies, authorities, and GBEs;
- Non-Commonwealth licensees and their employees;
- Manufacturers and suppliers of plant and substances; and
- Persons erecting or installing plant in the workplace.
