Australian Government - Comcare

Investigation of Workplace Incidents

The OHS (CE) Act provides for the conduct of workplace investigations of OHS incidents and accidents as appropriate. The goals of this aspect of the program are to ensure that:

  • appropriate remedial action is taken in workplaces to ensure the future health and safety of employees and others, and
  • instances of non-compliance are identified (in these cases, action to be taken by Comcare is determined in line with the Comcare Enforcement Policy)

Comcare’s investigation program is categorised into two types of investigation activity - Proactive and Reactive investigations.

Information about the investigation process and the powers of an investigator is detailed in the Comcare publication When an Investigator Calls (OHS03) [PDF].

A key source of information for Comcare in determining where investigations might be conducted is information gleaned from the notification of accidents and dangerous occurrences by employers in accordance with the notification regulations.
