FAQs on issuing a provisional improvement notice

I am a HSR considering issuing a provisional improvement notice (PIN) on my employer. What do I need to know and how should I proceed?

In the first instance refer to the Health and Safety Representatives Handbook (OHS 4), particularly pages 16-20. A blank PIN is supplied on page 30 and also in Schedule 1 of the Safety Arrangements Regulations. Remember that a PIN may only be issued if:

a) there is a breach of the OHS legislation (which must be detailed in the PIN as well as the reasons for the opinion that there is a breach); or

b) there has been a breach of the OHS legislation and you have reason to believe it will be breached again (again the breach or potential breach must be specified along with some evidence of the breach); and

c) consultations with the person supervising the work have failed to remedy the breach within a reasonable time period.
