Completing a Notification of Compliance with Maintenance Requirement for Plant other than Tower Cranes

Why is a maintenance notification required?

Some items of plant, due to their hazardous nature, require specific management to minimise any danger to the operator or other parties.

Your employer’s responsibilities regarding the notification of maintenance performed on an item of licensed plant (other than tower cranes) are set out in Regulation 4.47 of the Occupational Health and Safety (Safety Standards) Regulations 1994 (the Regulations). Regulation 4.47 states that an employer must take all reasonably practicable steps to ensure that inspections, maintenance and cleaning are carried as recommended by the plant designer, manufacturer or competent person (see paragraph 4.15(2)(h)). For each 12 months that your employer is licensed to operate the item of plant, you must provide the Safety, Rehabilitation and Compensation Commission (SRCC) with a notice explaining that the above has been carried out.

How do I notify the SRCC of maintenance carried out on the item of plant?

To notify the SRCC, complete the notification form, Compliance with Maintenance Requirement for Plant other then Tower Cranes (Regulation 4.47), and submit it to Comcare. For notifications containing more than 10 items, the multiple notification form may be more convenient. To obtain a copy, visit the plant licensing, registration and notification page on our website at www.comcare.gov.au. Details for submitting the notification are listed further down.

Please be aware for each 12 months your employer is licensed to operate an item of plant (other than a tower crane), you must provide the SRCC a notification of compliance with the maintenance requirement for that item.

How do I complete the application form?

The following information will help you complete the form.

Section 1: Current licence number

  • Enter the current licence number of the item of plant.

Section 2: Employer and applicant details

  • Enter the details of your employer, including the title of the Principal Officer.
  • Enter your details (i.e. the person making the application).

Please note:

1. The meaning of Principal Officer is defined in Section 5 of the Occupational Health and Safety Act 1991. For example, this would be the Chief Executive Officer (CEO) in a Commonwealth authority or in the case of a department this would be the Secretary.

2. You must have the written authorisation of the Principal Officer to sign the declaration at Section 6. You should read the declaration before proceeding.

3. After becoming aware of a change in you employer’s name, you complete and forward an application for Variation to a Licence to Operate Plant (Regulation 4.46) to the SRCC within 21 days under Regulation 4.46.

4. Personal information collected by Comcare in connection with the application will be used for the purpose of administering the Safety Standards Regulations, as well as the enforcement and administration of other legislation administered by Comcare. For more information, refer to the applicant’s statement of consent at Section 6.

    Section 3: Plant item identification

    • Enter the name of the manufacturer, date of manufacture, model number, serial number, vehicle registration number (if applicable) and any owner identification markings (such as organisation barcode or unique plant number) for the item of plant.
    • Tick yes or no to indicate if the plant’s design has been altered since design registration.

    Please note:

    1. Your employer must not use plant, or allow employees to use plant, if the plant has not had its design registered following an alteration to the design under Regulation 4.54. If the plant item has been altered, call the Plant Contact Officer on 1300 366 979 or email the plant helpdesk at ohs.plant@comcare.gov.au for further instructions.

    2. If your employer becomes aware of a design alteration to an item of plant, you must complete and forward an application for Variation to a Licence to Operate Plant (Regulation 4.46) to the SRCC within 21 days under Regulation 4.46. To complete this application, you will need to provide evidence of design registration following the alteration to the plant item.

    Section 4: Plant location

    • Tick the box to indicate if the plant is normally fixed or mobile.
    • Enter the location of the plant. For mobile plant, this is the depot or other place where the item is usually kept when not in use.

    Please note:

    If your employer becomes aware of the relocation of an item of plant, you must complete and forward an application for Variation to a Licence to Operate Plant (Regulation 4.46) to the SRCC within 21 days under Regulation 4.46.

      Section 5: Employer’s notification of compliance with maintenance for plant other than tower cranes

      • Tick yes or no to indicate if the you have carried out the inspections, checks, tests, maintenance and cleaning required for the item of plant.
      • Tick yes or no to indicate if the item of plant has been maintained in a safe condition and is safe to operate.

      Please note:

      Your employer must provide the notification advising the SRCC that the item of plant has been maintained in a safe condition and is safe to operate as soon as practicable after the end of the 12 month period to which it relates.

        Section 6: Consent and declaration by applicant

        • Carefully read the statement of consent.
        • Complete, sign and date the declaration.

        Please note:

        1. By signing the declaration, you agree to take responsibility for managing the plant item on behalf of the Principal Officer.

        2. Correspondence from Comcare regarding the plant licence will be addressed to you. Ensure the contact details provided at Section 2 are correct.
