
Following amendments to the Occupational Health & Safety Act 1991 introduced by the Occupational Health and Safety Amendment Act 2006, a new section provides that employees may be represented anonymously by an employee representative.
The employee representative can make an application to the CEO of Comcare to obtain a certificate that entitles them to represent the employee/s in specific consultations relating to the development or variation of health and safety management arrangements (HSMAs).
The application form has different sections that will need to be filled out by both the employee representative and the employee/s concerned.
Once the certificate has been issued, the employee representative must not reveal the identity of the employee/s who they are representing.
The certificate is valid for a 12 month period from the date of issue. However the certificate may be ceased earlier if requested by the employee/s concerned. See below for details.
If the employee/s covered by the certificate wish to have the certificate ceased, he/she/they must make an application to the CEO of Comcare. The certificate will only be ceased once ALL employees covered by the certificate formally make a request to Comcare by use of the prescribed form.
If, for example, there are 10 employees covered by the certificate who wish for it to cease to have effect, the application form will allow for multiple names to be listed.
