Regulator Performance Framework
Background
The Government has committed to reducing the cost of unnecessary or inefficient regulation imposed on individuals, business and community organisations by at least $1 billion a year. In order to achieve the Government's goal of reducing the burden of regulation, it is essential to improve the performance of regulators by supporting them to adopt consistent, risk-based approaches to administering regulation.
The Regulator Performance Framework encourages regulators to minimise their impact on those they regulate while still delivering the regulatory functions they are required to perform. The Framework also aims to affect positive and lasting cultural change within regulators to ensure improvements and efficiencies are ongoing.
Measuring performance
Measuring and publicly reporting performance will give business, the community and individuals confidence that regulators effectively and flexibly manage risk.
The Framework provides regulators with a standard set of key performance indicators to implement.
KPI | Description |
---|---|
KPI 1 | Regulators do not unnecessarily impede the efficient operation of the regulated entities |
KPI 2 | Communication with regulated entities is clear, targeted and effective |
KPI 3 | Actions undertaken by regulators are proportionate to the regulatory risk being managed |
KPI 4 | Compliance and monitoring approaches are streamlined and coordinated |
KPI 5 | Regulators are open and transparent in their dealings with regulated entities |
KPI 6 | Regulators actively contribute to the continuous improvement of regulatory frameworks |
Other features of the Framework include:
- measures of good regulator performance to be used by regulators to assess their achievements against the key performance indicators alongside outputs—or activity-based evidence specific to individual regulators
- a process for annual externally validated self-assessment
- a process for targeted external review every three years for a selected set of regulators
- a process for annual external review for a small number of major regulators.
Comcare's Regulator Performance Framework
Comcare, as the regulator of work health and safety under the Work Health and Safety Act 2011, and regulator of rehabilitation under the Safety,Rehabilitation and Compensation Act 1988, must implement the Framework by 1 July 2015, with the first assessment period to occur in the 2015-16 financial year.
Implementing and reporting against the Framework will assist Comcare to identify areas for improvement, direct resources for greater impact, and identify opportunities to reduce compliance costs.
Comcare's Regulator Performance Framework will include:
- Comcare outcomes-based key performance indicators and measures of good regulatory performance
- Comcare self-assessment methodology (the Methodology)
- Comcare reporting template.
