Our compliance and enforcement activities

Comcare has functions and powers under the Safety, Rehabilitation and Compensation Act 1988 (SRC Act) and the Work Health and Safety Act 2011 (WHS Act), which include regulatory functions and powers for compliance and enforcement.

Under the SRC Act, our compliance and enforcement activities relate to compliance by rehabilitation authorities and employers with their workplace rehabilitation obligations under Division 3 of Part III of the Act. They also concern the approval process for workplace rehabilitation providers under Division 2 of Part III of the Act, and compliance with the conditions of approval on the part of approved workplace rehabilitation providers.

Our compliance and enforcement activities under the WHS Act relate to the various duties and obligations that are owed under the Act, including the primary duty of care that is owed by persons who conduct a business or undertaking. We also consider applications for authorisations and approvals, such as licences for major hazard facilities and approvals of health and safety representative training courses.

Our Compliance and Enforcement Policy sets out Comcare’s approach to our compliance and enforcement activities in relation to both work health and safety and workplace rehabilitation. Comcare publishes Regulatory Guides on specific regulatory topics. These provide more detailed guidance than we can include in the Compliance and Enforcement Policy.
